The people next door had another party last night. This time with sentries posted so they could shut off the music and run inside when police showed up. That happened at least once. Then another neighbour went to talk to them after I gave up and went to bed (and managed to get to sleep... eventually) - and they threw things at him! Apparently they're going to be a bit like the "neighbours" on the north side were last year, which is extremely bad news.

Anyway, he went back to his house, phoned the police, and specifically asked for police for contact. I don't know how it ended up, but I know police were sent and they waited for backup from a second unit.

Fortunately, this is one of the few nonresident owners around here for whom I have a phone number and who actually answers his phone. I talked to him this morning; hopefully something will come of that, too.

I have neighbors like that across the street. They drink constantly(where do they get the money to drink like that?),and,last Fourth of july, mixed alcohol and large fireworks. Baaad combination.They also have what seems to be a terawatt amplifier they crank up on occassion..I can *feel* the bass hits in the floors and walls. To add to the charm, you get to pick up busted beer bottles out of the driveway. Calling the cops here(Lexington) is a waste of time. All the neighbors have, and I *think* they've actually shown up once. At least the cops in your area show up and do something.
I can deal with the occassional rowdy party, but the five times a week stuff gets old fast.

Sounds to me like he's got a case for battery. Or assault. I can never remember which is which.

In the civil context, generally, assault is when you cause a reasonable fear of offensive contact; battery is when you actually make contact. So if they just threw things at him, it's assault, but if they hit him, it's battery. Criminal definitions may be slightly different, as they're jurisdiction-specific, and don't rely on the common law like civil definitions do in the absence of a statute.

When you're at the point of quibbling over the semantics of "assault" vs. "battery," shouldn't the cops be dragging some people to jail regardless?

Time/date-stamped video works wonders for getting around the "sentries".

When we lived in Bothell, we had a group of college age guys living above us - parties nightly, and twice on weekends. It got so bad that we were taking the phone up with us and had already punched 91 when we went to dsicuss the noise with them, and a finger was on the other 1.

No riots, but lots of trash and debris afterwards. I think my favorite was the night that nearly everyone else in the neighborhood called the police within 5 minutes of each other - at 3:30 AM on a weeknight.
