No wonder the neoconservatives don't hate Mr. Obama's Supreme Court nominee; in confirmation hearings she not only supported the Bush administration's indefinite-detention-without-trial-or-appeal programme, she said that the US should've been considering itself at war in the 1990s.

Ms. Kagen has also written sympathetically of the use of obscenity labels as a method to control "hate speech" (see previous link), and, in 1997, urged then-President Bill Clinton to ban late-term abortion. From what little we know of her - and the administration has already proclaimed she won't answer any specific questions in hearings - she seems to have a highly "pragmatic" view of civil liberties, of rights, of power, which in practice translates to the ability to rationalise whatever a government wants to do. In short: from what little we know, she'll be an effective supporter of government power, replacing one of the votes in the slim 5-4 majority against claims like arbitrary arrest-and-imprisonment over the last decade.

And, of course, under Mr. Obama, that power has been extended to execution.

For years, the Democrats have told civil libertarians and progressives, "vote for us for judges! Vote for us for judges! If nothing else, vote for us for judges!" Now, they're giving you this. And even now, even here, on comment threads, I'm seeing "IT'S THEM OR THE TEA PARTIERS!!1!" That's how they've led you here, you fools.

Strong endorsement from strong-executive, pro-warrantless-wiretapping, pro-indefinite-arbitrary detention supporter and National Journal columnist Stuart Taylor. "Non-liberal, non-conservative, pragmatic," asserts that she really is just fine with her support of Bush-like executive power claims, which Mr. Taylor calls "not controversial" with "the great middle of Americans" and only of concern to "leftists." He lists as reasons to support her a lot of the reasons I'm opposed.

Scott Horton at Harpers Magazine talks about an article Ms. Kagen wrote:
Kagan notes the increase of presidential power as Congress builds the administrative and regulatory state... there is much to suggest her admiration for the evolution of the strong presidency in the period after World War II. Her career choices, often pushing back her academic career to accept appointments in Democratic administrations, reflect an attitude of engagement with it... Elena Kagan will be no enemy to the powers of the executive... She pays lip service to the limitations on executive authority contained in the Constitution, but she’s generally in the thrall of executive power.

On this point the Kagan choice probably reflects the perspective of the man who made it, Barack Obama: not the Obama of the 2008 presidential campaign but rather the Obama who has governed since January 20, 2009—broadly continuing the strong executive posture of the Bush team in national security matters.

If I'm doing my time conversions right, and I'm pretty sure I am (the forex is reported in GMT; the DJIA in Eastern Daylight; eastern daylight time + 0400 = GMT, right?) these two rectangles are the same hours. Those curves are damn near identical. And you can make an argument that the few hours before that are pretty similar too, but with a wider swing. That's neat.

Busy getting ready for the show tomorrow. John Seghers came over and gave me a lot of help last night – he set up my instrument pick up pre-amps for me and made them sound very very tasty. Thanks John! Right now I’m taking a break from rehearsing and doing laundry and realising I really need to clean the birdcage and scrub down the kitchen sink. I’ve gotten a little private feedback on it that’s been really pretty good so far, except for one bit of commentary about how much my voice sucks. That kind of thing would be easier to deal with if I wasn’t so damn neurotic sometimes, by which I mean all the time, srsly. Y HLO THER INTERNET LET ME ADD 2 YR FACEBOOKS or something
