I’ve been a little asleep on this multi-pronged attack against internet speech, but this tine is perhaps the worst of the fork: the Kids Online Safety Act. The fash right have already promised to use this bill against LGBT people (particularly trans people).
They will use it to ban queer content from the internet as much as they can. The mechanism for enforcement is giving state attorneys general the right to sue:
In any case in which the attorney general of a State has reason to believe that an interest of the residents of that State has been or is threatened or adversely affected by the engagement of any person in a practice that violates this Act or a regulation promulgated under this Act, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in a district court of the United States or a State court of appropriate jurisdiction
text of bill SB1409 (2023)
With 20 Republican states moving to ban queer content in offline life too, even to the point of banning medical care, they will absolutely succeed to one degree or another, Section 2 (10) (A-D) be damned. And the reason I know that is that again, they’re saying right now that they will use it to censor queers. That’s not speculation, it’s the stated plan.
And a small fleet of Democrats are also onboard, because “what about the children.”
So hit up your Senators about this. This one really can’t see the light of day. Do what you can to stop it, because… yeah. It really, really needs to be stopped.
Unless you want Florida, Texas, and Oklahoma dictating what you can say about LGBT people on the Internet.
