The jury ruled that the escort taking his money (paid theoretically for time) without having sex with him (which he believed was part of the deal) constituted "nighttime theft," and that he was therefore allowed to use deadly force against her. Horridness of that aside, this is despite the fact that prostitution is illegal in Bexar County, Texas, meaning that if she didn't commit an illegal act, he could legally shoot and kill her.

Or - and this is crazy, but hear me out - we could legalize prostitution and allow these sorts of cases to run through small claims court.

I'm no lawyer, but - not generally, not as I understand it. There has been one particularly famous case which did, but that was a couple of centuries ago, involving libel law, and was where North American approaches to libel changed from the English approach.
