Various laws have been in place saying no, you can't do that, it's bullshit; it's a way to make violating contract on a mass scale legal. And until yesterday, the courts have sided with that view.

Not at all. The Federal Arbitration Act (http://en.wikipedia.org/wiki/Federal_Arbitration_Act) says that you can do all those things, the Ninth Circuit ruled it unconstitutional, and the Supreme Court overturned them in accordance with a long line of precedent.

Which is not to say it's not B.S., but it's Congress's B.S., not the Court's, and Congress can fix it at any time they choose.
